Yes, even Bernie Sanders voted to allow this. And yet, none of these legislators would have the power to vote away your rights in this manner if it weren’t for the third-party doctrine. I propose a solution for eliminating the doctrine, one that is rooted in the common law, and that preserves the ability to conduct proper law enforcement.
